Fair Use Policy

1. Purpose

This Fair Use Policy (“Policy”) is designed to ensure that all MailBeast users have equitable access to our platform and resources. Even when subscription plans include “unlimited” features, this Policy establishes guidelines to prevent abuse, maintain service quality, and protect the experience of all users.

MailBeast reserves the right to apply this Policy to ensure the platform remains stable, secure, and available for legitimate business use.

2. Scope and Applicability

This Policy applies to all users of the MailBeast platform, regardless of subscription plan. By using MailBeast, you agree to comply with this Policy, which is incorporated into and forms part of our Terms of Service. In the event of a conflict between this Policy and the Terms of Service, this Policy shall take precedence regarding usage matters.

3. Fair Use Standards

We define fair use as usage that is consistent with legitimate business email marketing activities. This includes:

• Conducting B2B cold email outreach to prospects with a legitimate business purpose
• Managing email campaigns and sequences for your own organization
• Using warmup features to improve deliverability of your connected email accounts
• Utilizing AI features to classify and manage email responses
• Tracking campaign performance through our analytics tools

Usage that is abnormal or excessive compared to the average user on the same plan, or that negatively impacts other users or our infrastructure, may be subject to review and action under this Policy.

4. Prohibited Activities

The following activities are prohibited and constitute violations of this Policy:

Spam and Legal Violations

• Sending unsolicited bulk email (spam) or email to purchased/scraped lists without proper consent
• Violating anti-spam laws including CAN-SPAM, GDPR, CASL, and similar regulations
• Sending emails containing phishing attempts, malware, or fraudulent content
• Impersonating individuals or organizations in your outreach
• Failing to include functional unsubscribe mechanisms or honor opt-out requests

Platform Abuse

• Circumventing or attempting to bypass rate limits, safety controls, or usage restrictions
• Using automated tools or bots to abuse platform features
• Causing excessive load on our infrastructure or network congestion
• Interfering with other users' access to or enjoyment of the Service
• Exploiting vulnerabilities or bugs in the platform

Warmup Abuse

• Abusing the email warmup feature for purposes other than improving deliverability
• Using warmup interactions to artificially inflate engagement metrics
• Extracting, copying, or storing warmup participant information
• Using warmup features for accounts you do not own or control

Commercial Restrictions

• Reselling, redistributing, or sharing your account access with third parties
• Using the Service to provide email marketing services to others (agency use requires appropriate plan)
• Commercially selling or licensing data obtained through the platform
• Operating the Service on behalf of a competitor for benchmarking purposes

5. Plan-Specific Guidelines

While we aim to provide generous usage allowances, certain thresholds may require additional review to ensure fair access for all users:

6. Monitoring and Compliance

MailBeast monitors usage patterns to ensure compliance with this Policy and to maintain platform integrity. Our monitoring is designed to:

• Identify usage patterns that may indicate abuse or policy violations
• Detect spam sending or other harmful activities
• Protect the deliverability reputation of all users
• Ensure fair resource allocation across the platform

We may implement automated controls, rate limits, or other technical measures to enforce this Policy. If your usage triggers a review, we may contact you to verify the legitimacy of your activities and request additional information.

7. Consequences of Violations

Violations of this Policy may result in one or more of the following actions, at MailBeast's sole discretion:

Progressive Enforcement

1. Warning: A notification identifying the policy violation and requesting immediate correction
2. Temporary Limits: Restrictions on sending volume, connected accounts, or specific features while the issue is resolved
3. Suspension: Temporary suspension of access to some or all platform features
4. Termination: Permanent termination of your account and access to the Service

Immediate Action

For severe violations, including spam sending, legal violations, or activities that threaten platform integrity, we may take immediate action without prior warning, including instant account suspension or termination.

No Refunds

If your account is suspended or terminated due to violations of this Policy, you will not be entitled to any refund of prepaid fees, in accordance with our Terms of Service.

Additional Actions

We reserve the right to report illegal activities to law enforcement authorities and to seek recovery of costs incurred due to policy violations.

8. Appeals

If you believe your account has been subject to enforcement action in error, you may appeal via MailBeast Support Chat within 14 days of the action. Your appeal should include:

• A clear explanation of why you believe the action was in error
• Any relevant evidence supporting your position
• Steps you have taken or will take to ensure compliance

We will review appeals promptly and communicate our decision. Our decision on appeals is final.

9. Changes to This Policy

We may update this Fair Use Policy from time to time. Changes will be effective upon posting the updated Policy to our website. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
